Nudge terms of use

These terms are an agreement between you and Swift InfoCorp (Udyam Registration No. UDYAM-DL-07-0005541; "we", "us"), which makes Nudge. By creating an account or using Nudge, you agree to them. Please also read our privacy policy.

1. Who can use Nudge

You must be at least 18 years old. You need a mobile number that uses WhatsApp, because we send your login code there. You are responsible for keeping your phone and account secure, and for activity in your account.

2. What Nudge does, and its limits

Nudge lets you create reminders and notifies you on your phone at the time you set. For reminders you mark "must not miss", and while WhatsApp reminders are on, it also sends them to your WhatsApp if you have not responded.

Important: Nudge is a convenience tool. It is not a medical, safety or emergency service, and must not be your only safeguard for anything where a missed reminder could cause harm. Delivery depends on things outside our control: your phone's settings and battery management, your network, Google and Meta. We work hard to deliver every reminder on time, but we cannot guarantee it.

3. The pilot

Nudge is currently in a pilot. During the pilot, Nudge is free. Features may change, and there may be interruptions. We may end or change the pilot with reasonable notice in the app.

4. Fair use of WhatsApp messages

WhatsApp messages cost us money, and the Nudge WhatsApp number is shared by everyone. To keep it working for all users, we apply limits:

We may suspend or close accounts that break these terms. Where reasonable, we will tell you why.

6. Your content

Your reminders belong to you. You give us permission to store and process them only to provide Nudge to you, as described in our privacy policy. You are responsible for what you write in your reminders.

7. Ending your account

You can stop using Nudge and delete your account at any time (see Delete your Nudge account). We may close accounts as described in section 5, or if we discontinue Nudge with reasonable notice.

8. Disclaimers and liability

To the extent the law allows, Nudge is provided "as is" and "as available", without warranties of any kind. To the extent the law allows, we are not liable for indirect or consequential loss, or for loss caused by a reminder that was late or not delivered. Our total liability to you for any claim about Nudge is limited to the amount you paid us for Nudge in the 12 months before the claim, or ₹1,000 if you paid nothing.

Nothing in these terms limits rights you have under Indian law that cannot be limited, including under the Consumer Protection Act, 2019.

9. Changes to these terms

We may update these terms. We will give notice in the app before material changes take effect. If you keep using Nudge after that, you accept the updated terms.

10. Law and disputes

These terms are governed by the laws of India. Courts at New Delhi have jurisdiction, subject to any rights you have to bring a consumer complaint elsewhere.
